IPR: China's drive for patents in 'wrong direction'

CHINA'S drive to produce millions of new patents in the next few years as part of a switch from a "made in China" to "designed in China" economic model will curtail innovation standards, a European study warned yesterday.

China is seeking to transform itself from being the world's factory floor into a global pioneer by setting ambitious state-mandated patent targets - a goal that has already resulted in it surpassing the United States last year in patent filings.

China's ongoing efforts at cracking down on intellectual property rights violation are paying dividends, according to the Ministry of Commerce, after it revealed that the number of cases had dropped in the first five months of the year.

But despite the move in the right direction, Jiang Zengwei, vice-minister of commerce, said China will continue to introduce stricter criminal controls on IPR violations, to further curb piracy and counterfeiting.

IPR China: Apple pays US$60m to settle iPad dispute

APPLE Inc has agreed to pay US$60 million to Shenzhen-based Proview to end a dispute over the iPad trademark on the Chinese mainland that started two years ago.

Both sides reached the settlement agreement on June 25 and Apple had transferred the funds to the account of the Higher People's Court of Guangdong Province, the court said on its website today.

WebTV: PPTV must pay for infringing copyright of Japanese TV series

PPTV was ordered to pay 25,000 yuan (US$3,967) for infringing the copyright of the popular Japanese science fiction TV series "Ultraman Diga" on its online video-sharing platform, the Pudong New Area People's Court said yesterday.

The plaintiff, Shanghai Character License Administrative Co (SCLA), said PPTV uploaded the TV series onto its website on January 26 last year without approval. The video site then screened the series, recommended on a popular animation billboard, to thousands of online viewers free of charge.

NESTLING in a sleepy southern district of Kunming city in southwest China is a 10,000 square meter, four-story building that could make Swedish furniture giant Ikea uneasy.

11 Furniture, as the store is known, copies Ikea's blue and yellow color scheme, mock-up rooms, miniature pencils, signage and even its rocking chair designs. Its cafeteria-style restaurant, complete with minimalist wooden tables, has a familiar look, although the menu features Chinese-style braised minced pork and eggs instead of Ikea's Swedish meatballs and salmon.

IPR China: 50 charged in fight against violation

NEARLY 50 suspects in 26 cases have been charged with intellectual property rights violation involving 22.48 million yuan (US$3.47 million) in recent weeks, prosecutors said yesterday.

Of the 26 cases, 16 were related to selling counterfeits, and five cases involved more than 1 million yuan.

China PiracyChina's software piracy rate dropped 2 percentage points from 2009 to 2010, but the commercial value of the illegitimate software last year was up by 1.55 percent, to 130.94 billion yuan ($20.1 billion), a new survey shows.

The survey by Internet research firm Chinalabs said the overall piracy rate declined from 14 percent to 12 percent.

The State Intellectual Property Office commissioned Chinalabs to track such data since 2005. More than 4,800 individual and corporate respondents across the country participated, and results were released on Thursday.

China has detected more than 100,000 cases involving violation of intellectual property rights (IPR) in the past five months, Vice-premier Wang Qishan said at a national conference in Qingdao on Friday.

While praising the results so far, Wang ordered government departments across the country to continue their efforts by focusing on key markets and fields, such as agricultural products, food and pharmaceuticals.

"Harsher criminal and economic punishments should be imposed in order to truly intimidate violators," Wang said.

Wang also urged government departments to purchase and use legitimate computer software, Xinhua reported.

China Applications for trademark registration up 25% in Q1

Applications for trademark registration in China increased 25.4 percent in the first quarter from a year earlier and will hit a record high this year, said a government official on Monday.

China had 4.885 million effective registered trademarks by the end of March and is estimated to have 8 million at the end of 2015, said Fu Shuangjian, deputy director of the State Administration of Industry and Commerce.

He said that by the end of March, the number of applications had reached 8.563 million, topping the world for the ninth year.

Meanwhile, the country continued to clamp down on trademark violations. Since Chinese police launched a special campaign in November targeting fake goods ranging from food, medicine, cosmetics, to electronics, home appliance, and DVDs, they had investigated 59,500 trademark rights infringement cases, with 9,691 involving overseas companies, by April 15.

Investigations of a copyright fight between more than 40 Chinese writers and Baidu, China's largest search engine, are underway, an official with China's copyright watchdog group said Thursday.

Yan Xiaohong, deputy director of the National Copyright Administration, said during a press conference that the search engine showed a "proactive" attitude during a meeting between its senior managers and copyright authorities.

Mobile equipment giant Ericcson will sue Chinese telecom firm ZTE after accusing it of infringing its patents, the Financial Times reported.

Ericcson has filed lawsuits against ZTE in the United Kingdom, Italy and Germany, saying the Chinese company has breached its patents relating to second- and third-generation wireless technologies known as GSM and WCDMA, the paper said late on Friday.

Ericcson, the world's biggest mobile phone equipment manufacturer, will ask the courts to ban the sales of ZTE products that include technologies where the Swedish company's patents have allegedly been breached.

China's top industry and commerce administrator has pledged that every effort will be made to protect trademarks registered by overseas firms amid a growing number of applications.

Zhou Bohua, minister of the State Administration for Industry and Commerce (SAIC), said the administration will boost its campaign to curb trademark violations in cooperation with judicial departments.

Baidu, China's search engine giant, was blamed Tuesday by Chinese writers for participating in copyright violations, since the website offers free online excerpts of unauthorized stories and books.

On March 15, which is World Consumer Rights Day, more than 40 writers said in an open letter that Baidu stole their work and infringed on their copyrights.
